It is believed that this was the first criminal code compiled by the Meiji government in 1868, shortly after the establishment of the new Meiji government. However, it was not promulgated or implemented nationwide, but was merely a set of internal government guidelines outlining criminal law policy. Its contents are based on the Ritsuryo system and consist of 12 chapters and 124 articles (also counted as 121), and are said to have been influenced by the Taiho Code, Ming Code, Qing Code, the former shogunate's Kojikata Osadamaki, and especially the Higo Domain law Penal Code Sosho. 明治1 (1868) 年明治新政府樹立直後のきわめて早い時期に編纂が行われたとの考証がなされている明治政府最初の刑法典。しかし一般公布や全国的な施行をみた法典ではなく,刑事行刑方針を示した政府部内の準則にとどまる。その内容は律令法系に属し各例以下 12編また 124 (121とも数えられる) の条目から成り,大宝律,明,清律,旧幕府『公事方御定書』,特に肥後藩法『刑法草書』の影響を受けているとされる。
