Money Lending Business Act

This law amended the Money Lending Business Regulation Law (promulgated in May 1983 and put into effect in November 1983). In response to the Supreme Court's ruling in January 2006 ordering money lenders to repay unsecured loans to individuals with interest rates between the upper limits of the Interest Rate Restriction Law (15-20% per year) and the Investment Law (29.2% per year), this law was enacted in December 2006. The law aims to abolish the gray zone interest rate by the end of 2009, lower interest rates to 15-20% per year, and make violations subject to criminal penalties. In addition, to prevent borrowers from borrowing more than they can repay, and to prevent multiple debtors, it will generally prohibit loans that exceed one-third of annual income. It also requires money lenders to register with credit information agencies and raises the condition for registering net assets to 50 million yen or more.

貸金業規制法（1983年５月公布，1983年11月施行）を改正した法律。利息制限法の上限（年15〜20％）と出資法の上限（年29.2％）の間の金利（グレーゾーン金利）による個人向け無担保貸付けに関する過払い金返還訴訟で，2006年１月に最高裁判所が貸金業者に返還を命じる判決を出したことを受けて，2006年12月に成立。2009年末をめどにグレーゾーン金利を廃止して，金利を年15〜20％に引き下げ，違反は刑事罰の対象とする。また，借り手の返済能力を超える〈借りすぎ〉を防止し，多重債務者を出さないために，年収の３分の１を超える貸付けを原則禁止とする。貸金業者には信用情報機関への登録を義務づけ，純資産額の登録条件は5000万円以上に引き上げるなどの内容を含む。
