Termination agreement clause - Dismissal agreement clause

...Similar provisions are sometimes also found in labor agreements. However, labor agreements often restrict employers from firing workers by including provisions (called dismissal consultation clauses or dismissal consent clauses) that require employers to consult with the union or obtain its consent when firing workers (union members). Regarding such provisions, academic theory and precedents generally hold that the list of reasons for dismissal in work rules and labor agreements should be interpreted in a limited sense (limited list) to mean that employers cannot fire workers for reasons other than those listed above, and that dismissals that violate such rules and standards are invalid because they have legal effect (Article 93 of the Labor Standards Act and Article 16 of the Labor Union Act).
