Permanent Neutrality Treaty

…Moreover, many treaties not only require that the independence, territory, and neutrality of the permanently neutral country not be violated, but also impose on the other treaty parties the obligation to protect and eliminate any infringement of the independence, territory, and neutrality of the permanently neutral country if such infringement is caused by any other country. A treaty that creates such a relationship of rights and obligations is called a permanent neutrality treaty, and the relationship of rights and obligations thus created is permanent neutrality. The term "permanent neutrality" was first used to refer to the status given to the Mediterranean island of Malta by the Treaty of Amiens, the Anglo-French peace treaty of 1802. Later, in 1815, the Congress of Vienna granted a similar status to Switzerland, which had adopted a neutral policy, and this was called "permanent neutrality." …

…さらに,多くの条約は,単に永世中立国の独立,領土,中立を侵さないのみならず,永世中立国がいずれかの国によって侵された場合に,これを守り,侵害を排除する義務を他の条約当事国に課している。こうした権利義務関係をつくり出す条約を永世中立条約といい,こうしてつくり出された権利義務関係が永世中立である。これを永世中立と呼ぶようになったのは,1802年の英仏講和条約である〈アミアンの和約〉が地中海のマルタ島に与えた地位をさすためにLa neutralité permanente(永世中立)の語を用いたことに始まり,その後15年のウィーン会議が,中立政策をとっていたスイスに対し,同様の地位を与え,これをLa neutralité perpétuelle(永世中立)と呼んだ。…
