An act that becomes a commercial act when it is performed repeatedly and continuously as a business. The Commercial Code lists 13 types of acts that fall under commercial acts (Article 502): speculative lending and borrowing and the execution of such acts, manufacturing and processing for others, supply of electricity and gas, transportation, contracting for work and labor, acts related to publishing, printing, or photography, market transactions, currency exchange and other banking transactions, insurance, accepting deposits, acting as an intermediary or middleman, accepting commercial acts as an agent, and accepting trusts. However, this does not include acts of people who manufacture things or engage in labor solely for the purpose of receiving wages, such as manual labor (Proviso, Article 502 of the Commercial Code). 営業として反復継続して行なうことにより商行為となる行為。商法は,営業的商行為にあたる行為として,投機貸借とそれらの実行行為,他人のための製造・加工,電気・ガスの供給,運送,作業・労務の請負,出版・印刷または撮影に関する行為,場屋取引,両替その他の銀行取引,保険,寄託の引き受け,仲立ち・取次ぎ,商行為の代理の引き受け,信託の引き受けという 13種類の行為を限定的に列挙している(502条)。ただし,手内職等のもっぱら賃金を得る目的で物を製造し,または労務に従事する者の行為は含まれない(商法502条但書)。
