Thus, while the Civil Code is based on the principle that parents and children have the same surname, it does allow for a "change of surname" that occurs naturally as a legal effect of a civil legal act (marriage, adoption, etc.). Furthermore, as a general provision, if a child subsequently (or by birth) has a different surname from his/her father/mother due to a divorce or other reason, the child may change to the surname of the parent with the permission of a family court ruling (Article 9, Paragraph 1, Class A, Item 6 of the Domestic Relations Adjudication Law) under the system of "changing a child's surname" (Civil Code, Article 791; Family Registration Law, Articles 98 and 99).
