Legally, it refers to the act of giving a strong stimulus to make or strengthen the decision to do something illegal. Synonymous with incitement. An example of such an act being prohibited is inciting public servants to engage in industrial action. Public servants are prohibited from engaging in industrial action, and anyone is prohibited from planning, instigating, or inciting industrial action. Public servants who violate such prohibitions lose their status protection (National Public Servant Law, Article 98, Paragraph 3; Local Public Servant Law, Article 37, Paragraph 2). And anyone who engages in an act such as inciting industrial action is subject to criminal punishment (National Public Servant Law, Article 110, Paragraph 1, Item 17; Local Public Servant Law, Article 61, Paragraph 4). While engaging in industrial action itself is not punishable, prohibiting its preparatory activities with penalties is, in effect, no different from prohibiting industrial action with the threat of criminal punishment.

法律上は、違法な行為を決意させたり、その決意を強めたりするために勢いのある刺激を与える行為のことをいう。扇動と同義。このような行為が禁止される例に、公務員の争議行為をあおる場合がある。公務員は争議行為が禁止されており、また、だれであっても、争議行為を計画したり、そそのかしたり、あおることが禁止されている。このような禁止に違反した公務員は、身分上の保護を失う(国家公務員法98条3項、地方公務員法37条2項)。そして、とくに争議行為をあおるなどの行為をした場合には、だれであっても刑罰が科せられることになっている(国家公務員法110条1項17号、地方公務員法61条4号)。争議行為をすること自体は処罰されないが、その準備活動を罰則つきで禁止することは、実際上、争議行為を刑罰の威嚇をもって禁止するのと異ならない。
