In the old Chinese legal system, a system was in place to prevent bureaucrats from holding certain positions when they were appointed. It was also written as "kaibiki" (avoidance of relatives), and there were two main types: avoidance of relatives and avoidance of domicile. China has valued the family system since ancient times, and even the law allowed close relatives to hide their crimes from each other, so this system must have developed naturally. Avoidance of relatives means that people who are related by blood cannot hold positions in the same government office, while avoidance of domicile mainly refers to local officials not being appointed to positions in their domicile. 中国の旧法制で,官僚を任用する際,ある条件の地位を避けさせる制度。廻避とも書き,大別して親族回避と本籍回避の2種があった。中国では古来から家族制度を重んじ,律においても近親間では互いに犯罪を隠匿することを容認したくらいであるから,こういう制度も自然に発達したのであろう。親族回避とは,親属関係にある者が同一の官庁に奉職できないことをいい,本籍回避とは,主として地方官がその本籍地の官にはつけないことをさす。
