...the principle that once a person has been prosecuted for a crime, he or she cannot be prosecuted again for the same crime at a later date. This principle was already established in Roman law as ne bis in idem, and although it was temporarily rejected during the period of inquisition from the Middle Ages to the early modern period, after the French Revolution it has been recognized in almost every country as a basic principle of modern criminal procedure law. The Japanese Constitution also has a provision declaring this (Article 39).
