Private autonomie (English spelling)

In particular, the concept of autonomy was often used to describe the rights of citizens in what is now called private law, and the freedom of citizens that supports economic activity in capitalist society. Even today in German jurisprudence, the concept of "privat-autonomie" (principle of private autonomy) is used to mean the freedom of private individuals to form legal relationships of their own volition, and the content of this "private autonomy" includes freedom of contract, freedom of ownership, freedom of inheritance (wills), and freedom of association, which is a continuation of this history. Even in the backward and centralized German states, it was believed that proper private or civil law should be based on customary law, case law, and legal profession law, and should be outside the scope of the activities of the legislative power, and that even if it was subject to the legislative power, arbitrary legislation should not be permitted.
