Sexual assault

Under the Criminal Code, committing adultery with a girl aged 13 or over through violence or intimidation is punishable as rape (Article 177, first paragraph of the Criminal Code). Adultery means sexual intercourse. The punishment is imprisonment for a fixed term of two years or more. It is a crime that violates a woman's sexual freedom, but the means of violence and intimidation do not have to completely suppress the other person's resistance; it is sufficient if they make it extremely difficult for her to resist. For women under the age of 13, from the standpoint of sexual protection of minors, adultery constitutes this crime regardless of whether violence or intimidation is used (Article 177, second paragraph).
