In ancient Japan, laws stipulated marriages between nobles and low-class citizens and the ownership of children born to them. The Law of Men and Women of 645 (Taika 1) stipulated that children born between nobles and slaves should be given to the slave, and children born between slaves of different owners should be given to the slave mother. This principle was carried over into the Ritsuryo Code, and the Household Law and Household Marriage Law stipulated that intermarriage between nobles and low-class citizens was prohibited, and low-class citizens could only marry other low-class citizens of the same type, i.e., marriage by a commoner. However, children born when a nobleman married a woman who was not aware that she was a low-class citizen were considered noble, and children born between a family member or slave and a woman of the owner or his relatives outside of marriage were considered official low-class citizens. 日本の古代に,良民と賤民の婚姻や生まれた子の帰属を定めた法。645年(大化1)の男女の法は,良民が奴婢(ぬひ)との間になした子は奴婢につけ,所有者の異なる奴婢の間の子は母である婢につけると定めた。この原則は律令にも引き継がれて,戸令・戸婚律で,良民と賤民の通婚禁止,賤民は同じ種類の賤民とだけしか婚姻できないとする当色婚が定められた。ただし,良民が相手を賤民と知らずに結婚した場合の子は良民とされ,家人・奴が所有者やその親族のうちの女性と結婚以外の場合につくった子は官有賤民とされた。
