Here, "preparation" refers to acts of preparation for a crime, acts that occur before the start of the commission of a crime. For example, purchasing a weapon or poison with the intent of murder, or scouting a place to enter with the intent of burglary, are preparatory acts. However, in the Criminal Code, punishment for completed crimes is the rule, and punishment for attempted crimes is the exception (see the entry for "attempted"). Therefore, punishment for preparation, which is even further from the actualization of a crime than an attempt, is only allowed as an exception for extremely serious crimes. ここでいう〈予備〉とは犯罪の準備行為のことであり,犯罪の実行に着手する以前の行為をいう。例えば,殺人の目的で凶器や毒物を購入したり,侵入窃盗の目的で侵入先の下見をするなどの行為が予備行為である。もっとも,刑法典においては,既遂の処罰が原則であり,未遂の処罰は例外的である(〈未遂〉の項参照)。したがって,未遂よりさらに犯罪実現から遠い予備の処罰は,きわめて重大な犯罪について例外的に認められているにすぎない。
