Also called interpretive jurisprudence. A practical jurisprudence that aims to systematically and rationally clarify the normative meaning of positive law and to influence its application in court. Legal interpretation is the task of clearly and unambiguously determining the ambiguous normative meaning of the letters and sentences that make up positive law, and there are several types of interpretation, such as literal interpretation, logical interpretation, reductive interpretation, teleological interpretation, contra-interpretation, of course interpretation, and analogical interpretation. Since its establishment in ancient Rome, legal hermeneutics has occupied a central position in jurisprudence to the present day, but the emphasis has changed with the times. Since the theory of free law, legal hermeneutics has strengthened its character as an applied science that incorporates empirical scientific knowledge of humans and society. In the "legal hermeneutics debate" in Japanese legal circles after World War II, the practical nature of legal hermeneutics was emphasized. Depending on the field of positive law that it targets, legal hermeneutics is divided into constitutional law, administrative law, criminal law, civil law, commercial law, labor law, international law, and international private law. 解釈法学ともいう。実定法の規範的意味内容を体系的,合理的に解明し,裁判における法の適用に影響を与えることを目的とする実用法学。実定法を構成する文字および文章の多義的な規範的意味内容を明確かつ一義的に確定していく作業が法の解釈であるが,この作業には,文理解釈,論理解釈,縮小解釈,目的論的解釈,反対解釈,勿論解釈,類推解釈などと呼ばれるものがある。法解釈学は古代ローマで成立して以来,現代まで法学の中心的位置を占めているが,時代の変遷によって力点の変化がみられる。自由法論以後の法解釈学は人間や社会に関する経験科学的認識を取入れた応用科学としての性格を強めている。第2次世界大戦後の日本の法学界における「法解釈学論争」では,法解釈学の実践的性格が強調された。法解釈学は,その対象となる実定法の分野によって,憲法学,行政法学,刑法学,民法学,商法学,労働法学,国際法学,国際私法学などに分れる。
