The right to be free from discrimination in national politics in the enjoyment of rights and freedoms, and the burden of obligations. Therefore, this is the case when the principle of equality under the law guaranteed by the Constitution of Japan (Article 14, paragraph 1) is recognized as an individual right. This right to equality has generally been interpreted in its essence as a freedom right to eliminate unequal treatment by public authorities, but if one takes the view that strictly demands equality in results, the right to equality also has the character of a beneficiary right that demands the correction of inequalities that actually exist in society from public authorities, and is currently generally understood in this dualistic way.
