A business that acts as an agent or middleman for the principals who wish to sell or purchase goods is generally called an agent or middleman, and a sales agent or sales agency is one type of agent that acts primarily as an agent or middleman for sales. In contrast, a business that acts primarily as an agent or middleman for purchasing goods is called a purchasing agent or middleman. There are two types of agency: a contracting agent who negotiates and enters into contracts on behalf of the principal, who is the agent, and an intermediary agent who simply searches for and introduces business partners to the principal and acts as an intermediary for the transaction. Contracting agents are further divided into named agents (or direct agents) who negotiate and enter into contracts on behalf of others in their own name, and unnamed agents (or indirect agents) who negotiate and enter into contracts on behalf of others in their own name.

販売ないしは購買を行おうとする本人principalsのために，販売ないしは購買の代理または媒介を行う業者を，一般に代理商agent middlemenというが，販売代理商ないしは販売代理店は，そのような代理商の一形態であり，主として販売の代理や媒介を行うものをいう。これに対して，主として購買の代理や媒介を行うものを，買付代理商ないしは買付代理店という。　代理という行為は，委任者である本人の代理人として取引の交渉や契約を行う締約代理と，取引先を探して本人に紹介し取引の仲介をするだけの媒介代理とがあり，締約代理は，さらに，他人の名前で他人のために取引の交渉や契約を行う顕名代理(ないしは直接代理)と，自己の名前で他人のために交渉や契約を行う非顕名代理(ないしは間接代理)とに分けられる。
