Basilica Law Code (Latin)

This great code of law, consisting of 60 volumes, was compiled by the Byzantine Emperor Basil I (reigned 867-886) with the aim of restoring the classical law, and was promulgated in 892 by his son, Leo VI (reigned 886-912). While the legal code of Leo III (reigned 717-741), Ecloga legum, was heavily influenced by Christianity, this code adopted many legal texts from the code of Emperor Justinian through subsequent commentaries, and the volumes and chapters were arranged following the order of the Compendium of Laws. However, because this code was so large, there is no evidence that it was actually applied, and it appears that several summaries and excerpts were created and applied. The Basilica Code had a great influence on later generations, leading to the flourishing of legal studies, and ultimately giving rise to the Hexabiblos compiled by Harmenopoulos around 1345. This was made into a legal code in Greece in 1835, and was applied as law until the implementation of the Civil Code in 1941.

ビザンティン皇帝バシレイオス1世(在位867~886)が古典復古を目ざして編纂(へんさん)し、その子レオン6世(在位886~912)により892年に公布された、全60巻からなる大法典。レオン3世(在位717~741)の法典『エクロガ』Ecloga legumがキリスト教の大きな影響を受けたのに対し、これはユスティニアヌス帝の法典からその後の注釈書を通じて多くの法文を採用し、『勅法彙纂(いさん)』の配列に倣って巻、章が構成されている。しかしこの法典はあまりにも大部なため、実際に適用された痕跡(こんせき)はなく、いくつかの要約書や抜粋書がつくられて、それらが適用されたようである。『バシリカ法典』は後世に大きな影響を与え、法学を隆盛ならしめ、最終的には1345年ごろにハルメノプロスの編纂による『ヘクサビブロス』Hexabiblosを生んだ。これはギリシアで1835年に法典と定められ、1941年民法典の施行まで法律として適用された。
