An organization in the Cabinet that provides technical assistance to the Prime Minister and each minister on legal matters. It was established as the Legislative Bureau based on the 1952 Legislative Bureau Establishment Act, which was renamed the Cabinet Legislation Bureau Establishment Act in 1962, giving it its current name. Under the Director-General of the Cabinet Legislation Bureau are the Deputy Director-General for Cabinet Legislation, four departments and the Director-General's General Affairs Office, and the four departments have up to 24 counselors seconded from each ministry. The duties of the Cabinet Legislation Bureau are broadly divided into opinion work and review work. Opinion work involves submitting opinions upon request when doubts or disputes arise between the Cabinet or ministries regarding the application or interpretation of laws and regulations, and formulating government opinions on legal issues. The Cabinet Legislation Bureau has the highest authority to interpret law within the executive branch. Review work involves reviewing the original bills of bills, cabinet orders, and treaties drafted by each ministry before they are submitted to the Cabinet. The bill will be examined in detail with regard to its relationship with the Constitution of Japan and other current legal systems, as well as the appropriateness of the bill's contents, wording of the articles, and structure. The Constitutional Documents Research Office in the first division also organizes documents such as the Constitution Research Council's reports and minutes. 内閣に置かれ,内閣総理大臣や各省大臣を法制面で技術的に補佐する機関。1952年法制局設置法に基づき法制局として設置され,1962年同法が内閣法制局設置法に改題され現名称となった。内閣法制局長官の下に内閣法制次長,その下に 4部と長官総務室が置かれ,4部には各省庁からの出向者計 24人以下の参事官が置かれる。職務は意見事務と審査事務に大別される。意見事務は,法令の適用や解釈について内閣や省庁間で疑義や争いが生じた際に求めに応じて意見の具申をすること,法律問題に関する政府見解を作成することなどで,内閣法制局は行政府内において最高の法解釈権をもつ。審査事務は,内閣提出法案について,各省庁が起草した法律案,政令案,条約案の原案を,閣議にはかる前に審査する業務である。日本国憲法やほかの現行の法制との関係,法案内容,条文の表現,構成などの妥当性について精緻に検討する。また第1部に置かれた憲法資料調査室では,憲法調査会の報告書,議事録などの資料の整理などを行なっている。(→議院法制局,法,法律,立法)
