A general term for laws based on cartel subsidy policies. As described below, Japan had a history of cartel laws prior to World War II, dating back to the Export Association Law of 1925. However, the democratization of the Japanese economy was at the heart of postwar occupation policy, and the Antimonopoly Act was enacted as part of this, which led to fundamental changes in the significance and position of cartel laws within the legal system. First, the Antimonopoly Act enacted in 1947 was based on a strict competition policy that prohibited cartels in principle, so all prewar and wartime cartel laws were abolished. カルテル助成政策にもとづく法律の一般的呼称。第2次大戦以前の日本においては,後述するように,1925年の輸出組合法以来のカルテル法の歴史があった。しかし戦後の占領政策の中心に日本経済の民主化方針がすえられ,その一環として独占禁止法が制定されたため,法体系中におけるカルテル法の意義,位置づけに根本的な変革が加えられた。まず47年制定当初の独占禁止法は,カルテルの原則禁止という厳格な競争政策に依拠するものであったため,戦前・戦中のカルテル法はすべて廃止された。
