Japanese: 徳政文言 - とくせいもんごん

The correct term is the "tokusei guarantee phrase." It is one of the security phrases attached to medieval land sales certificates as a guarantee contract for the property being sold. It is a contract clause that guarantees that the seller will not demand the repossession of the property even if a tokuseirei is issued. Since medieval land sales certificates had a strong character of private documents, various security phrases were attached to them, but the tokusei phrase appeared on sales certificates after the Einin Tokuseirei. Later, the Muromachi Shogunate's tokuseirei stipulated that this private contract was invalid, but in reality it became established as a general security phrase and continued to be included until the early modern period.

正しくは徳政担保文言。中世の土地売券に付されている売渡物件の保証契約である担保文言の一つ。徳政令がだされても，売主は当該物件の取戻しを要求しないことを保証した契約条項。中世の土地売券は私的証文の性格が強かったため，種々の担保文言がつけられたが，徳政文言は永仁の徳政令以降の売券に登場した。その後室町幕府の徳政令ではこの私的契約を無効と定めたが，現実には一般の担保文言として定着し，近世初頭まで継続して記されている。
