Order to Submit - teishuu meirei

Japanese: 提出命令 - ていしゅつめいれい

Under the Code of Criminal Procedure, a confiscatory order is a compulsory measure in which the court orders the owner, possessor, or custodian of evidence or an item to be confiscated to submit the item (Article 99, Paragraph 2, Article 100). The other party is obligated to submit the item, and if they do not comply, not only will the item be seized, but the item submitted is considered to have the effect of taking possession. Therefore, the prevailing theory is that this order is a type of seizure. Submission orders are not permitted as a means of investigation by investigative agencies.

刑事訴訟法上，証拠物または没収対象物につき，その物の所有者，所持者，保管者に対し裁判所がその提出を命じる強制処分をいう (99条2項，100条) 。相手方が提出の義務を負い，これに応じなければ差押えがなされるばかりでなく，提出物に占有取得の効果が認められるところから，この命令自体を押収の一種とする学説が有力である。提出命令は捜査機関の捜査の手段としては許されていない。
