Konvaleszenz (Complete)
(1) In the Civil Code, a legal act that is invalid because of a lack of necessary requirements is made valid retroactively by later supplementing the requirements (for example, ratification of unauthorized agency). In addition, a perfection is also when a debtor who has incompletely performed later makes a full performance of the debt in accordance with the essence of the debt. (2) In the Civil Procedure Code, when a party who has neglected to perform a procedural act within a fixed period of time does so within a certain period of time after the period has expired, if there is no reason for which the party should be held responsible for the neglect. (3) In the Criminal Procedure Code, the provision on "request for restoration of right to appeal" is a relief provision that allows the perfection of the act of filing an appeal. (4) In the Administrative Appeal Act, if a request for review or an objection cannot be filed within the statutory period due to unavoidable reasons, it is sufficient to do so within one week from the day following the day on which the reason ceases to exist, and perfection is allowed.

(1) 民法上は,必要な要件を欠くために効力をもたない法律行為が,あとで要件が補完されて,初めにさかのぼり,有効となること (たとえば無権代理行為の追認) 。このほか,不完全履行をした債務者が,のちにあらためて債務の本旨にかなった完全な給付をすることも追完という。 (2) 民事訴訟法上は,不変期間内に行なうべき訴訟行為を怠った当事者が,その怠ったことにみずから責任を負わなければならない事由が存しない場合に,そのことを理由として,期間後一定期間のうちに必要な訴訟行為をすること。 (3) 刑事訴訟法上は,「上訴権回復の請求」の定めが,上訴申立行為の追完を認めた救済規定である。 (4) 行政不服審査法では,やむをえない事由で,法定期間内に審査請求あるいは異議申立ができなかった場合は,その事由がなくなった日の翌日から起算して1週間以内にこれを行なえばよいことにし,追完を認めている。
