Yukitoshi Takikawa

Criminal law scholar. His name can also be read as "Takigawa". Born in Okayama Prefecture. After graduating from Kyoto Imperial University, he became a judge at the Kyoto District Court, but in 1918 (Taisho 7), he was transferred to the Faculty of Law of Kyoto Imperial University, where he taught criminal law. After studying in Germany for over two years, he became a professor in 1924. In 1933 (Showa 8), the so-called Takigawa Incident (Kyoto University Incident) occurred, and on May 26 of the same year, he was ordered to take a leave of absence by the government. He worked as a criminal lawyer until the end of the war. In 1946 (Showa 21), he returned to his position as a professor at Kyoto Imperial University, and thereafter served as Dean and President of the Faculty of Law at the same university. During that time, he became the president of the Japanese Criminal Law Association and a member of the Japan Academy. His academic style was based on classical retributive theory and objectivist criminal law theory, and he is famous for introducing the theory of elements of crime to Japan, as he emphasized the protection of individual human rights.

刑法学者。「たきがわ～」とも読む。岡山県に生まれる。京都帝国大学卒業後、いったん京都地方裁判所判事となったが、1918年（大正7）京都帝国大学法科大学助教授に転官し、刑事法学を担当。2年余のドイツ留学ののち24年同教授となる。33年（昭和8）いわゆる滝川事件（京大事件）が起こり、同年5月26日に政府から休職を命ぜられ、終戦後まで刑事専門の弁護士として活躍。46年（昭和21）ふたたび京都帝国大学教授に復職し、以後、同大学法学部長・総長を歴任。その間、日本刑法学会理事長、日本学士院会員となる。その学風は古典主義的な応報刑論、客観主義刑法理論で、個人の人権保障を強調するところから、日本に構成要件論を導入したことで有名。
