Payment of the price - Daikabensai

A person who purchases mortgaged real estate is relieved of the burden of the mortgage by paying the mortgagee the purchase price upon the mortgagee's request. For example, if a mortgage is established on real estate owned by B to secure A's claim against B, and C buys the real estate from B, A requests C to pay the purchase price to him/her, and C pays the price to A in response to the request, A's mortgage is extinguished in favor of C (Civil Code Article 378). In other words, A can no longer assert to C that he/she is the mortgagee. This is called payment in lieu. A distinctive feature is that A's mortgage is extinguished even if the price is insufficient to cover A's claim.

抵当不動産を買入れした者が、抵当権者の請求に応じて、その代金を抵当権者に支払うことによって、自己に課せられる抵当権の負担を免れること。たとえば、甲の乙に対する債権の担保のために乙所有の不動産に抵当権が設定されている場合で、その不動産を丙が乙から買ったときに、甲が丙に対して売買代金を自分に支払うよう請求し、その請求に応じて丙が甲に代金を支払うと、甲の抵当権は丙のために消滅する（民法378条）。すなわち、甲は自分が抵当権者であることを丙に対して主張できなくなる。これを代価弁済という。代金額が甲の債権額に足りない場合でも甲の抵当権は消滅する点に特色がある。
