A person who purchases mortgaged real estate is relieved of the burden of the mortgage by paying the mortgagee the purchase price upon the mortgagee's request. For example, if a mortgage is established on real estate owned by B to secure A's claim against B, and C buys the real estate from B, A requests C to pay the purchase price to him/her, and C pays the price to A in response to the request, A's mortgage is extinguished in favor of C (Civil Code Article 378). In other words, A can no longer assert to C that he/she is the mortgagee. This is called payment in lieu. A distinctive feature is that A's mortgage is extinguished even if the price is insufficient to cover A's claim.
