A method of adjusting the amount of damages in the calculation of damages due to tort or breach of contract when the victim or creditor has suffered damage but has also gained profits related to the damages. The amount of profit received by the victim or creditor is deducted from the amount of damages. Although this is not permitted under the Civil Code, it is unanimously accepted in academic theory and case law because damages are intended to recover actual damages suffered. For example, if a building is burned down as a result of tort, the amount of fire insurance paid to the victim is deducted from the amount of damages paid to the victim by the tortfeasor. 不法行為,債務不履行による損害賠償の算定にあたって,被害者または債権者が損害をこうむった反面,その損害に関連して利益をも得ている場合における損害賠償額の調整方法。被害者または債権者が受けた利益額を損害賠償額から控除する。民法の条文上認められているものではないが,損害賠償が現実にこうむった損害の回復を目的としているものであることから,学説・判例上異論なく承認されている。たとえば,不法行為によって建物が焼失した場合,被害者に支払われた火災保険金額を,加害者から被害者に支払われる損害賠償額から控除することになる。
