Profit and Loss Offset - Sonekisousai

Japanese:
Profit and Loss Offset - Sonekisousai
A method of adjusting the amount of damages in the calculation of damages due to tort or breach of contract when the victim or creditor has suffered damage but has also gained profits related to the damages. The amount of profit received by the victim or creditor is deducted from the amount of damages. Although this is not permitted under the Civil Code, it is unanimously accepted in academic theory and case law because damages are intended to recover actual damages suffered. For example, if a building is burned down as a result of tort, the amount of fire insurance paid to the victim is deducted from the amount of damages paid to the victim by the tortfeasor.
