Records of proceedings in civil cases

It is a bound document containing the complaint, answer, preparatory brief, offer for evidence, service report, oral argument record, evidence examination record, original and certified copies of the judgment, etc. The clerk of the court where the lawsuit is pending or the clerk of the court of first instance is responsible for its storage. As a general rule, anyone can request a clerk to inspect civil lawsuit records, as long as it does not interfere with preservation or court business (this is an expression of the principle of public access, Article 91 of the Civil Procedure Act). In addition, the parties and interested parties can request a clerk to make a copy or to be provided with an authentic copy, certified copy, or extract. By reading the records, one can learn the specific progress of the lawsuit.

Records of proceedings in criminal cases

There are no regulations regarding what documents must be bound, but all documents, including various reports, documentary evidence, and warrants, are bound. In criminal proceedings, it is particularly important that facts appearing in the court records, etc., that are sufficient to believe that there is a reason for an appeal must be cited in the petition for appeal. After the initiation of prosecution, criminal court records can be inspected and copied by the defense attorney (Criminal Procedure Law, Article 40). After the case is concluded, anyone can inspect them (Criminal Procedure Law, Article 53).

民事訴訟における訴訟記録

訴状、答弁書、準備書面、証拠の申出書、送達報告書、口頭弁論調書、証拠調べ調書、裁判の原本・正本などをとじたものである。保管は、訴訟が係属中の裁判所の書記官あるいは第一審裁判所の書記官が責任をもつ。民事訴訟記録は、保存または裁判所の執務に支障のない限り、原則としてだれでもその閲覧を書記官に請求できる(一般公開主義、民事訴訟法91条、公開主義の表れである)。また、当事者、利害関係人は謄写または正本・謄本・抄本の交付を書記官に請求できる。記録を読むことにより、訴訟の具体的経過を知ることができる。

刑事訴訟における訴訟記録

どのような書類をとじるかについて規定がないが、各種の調書、書証、令状等いっさいの書類がとじられている。刑事訴訟では、控訴の申立てに訴訟記録等に現れている事実であってその事由があることを信ずるに足りるものを援用しなければならない点で、とくに重要である。刑事訴訟記録は、公訴の提起後は、弁護人が閲覧・謄写できる(刑事訴訟法40条)。事件の終結後は、だれでも閲覧できる(同法53条)。
