In a broad sense, it refers to a general legal stance that places emphasis on how the law functions in real society rather than on its form or content. In this sense, the liberal legal theory represented by E. Ehrlich and H. Kantorovich in Germany in the early 20th century, as well as the interest jurisprudence advocated by P. Heck, are also included in sociological jurisprudence. In contrast, sociological jurisprudence in the narrow sense refers to a legal stance that was given theoretical expression by R. Pound, with OW Holmes and BN Cardoso as its pioneers, against the backdrop of the pragmatism philosophical movement in the United States in the late 19th century.
