Payment place - Shiharaibasho

Japanese: 支払場所 - しはらいばしょ

Generally, it means the place where payment is to be made as the fulfillment of a debt (see the section on "payment"), but in the case of a bill or check, it means the place stated on the instrument as the place where payment is to be made. Payment of a bill (check) is generally made at the place of business or address of the payor or issuer (in the case of a promissory note) located within the place of payment (payment at the same place or at the place of payment), but if the issuer or payor specifies a place on the instrument other than the place of payment when issuing or accepting the bill, presentment of payment and the creation of a protest certificate must be made at this place of payment (Bills of Exchange Act, Articles 4, 27, and 77, Paragraph 2; Cheques Act, Article 8).

一般には債務の履行としての支払をなすべき地点をいう(〈弁済〉の項参照)が，手形または小切手に関しては，その支払をなすべき場所として証券上に記載された地点をいう。手形(小切手)の支払は，支払地のなかにある支払人または振出人(約束手形の場合)の営業所または住所でなされる(同所払･当地払)のが原則であるが，振出人または支払人が振出しまたは引受けに際し支払地内にある，それ以外の場所を証券上に指定したときは，この支払場所において支払呈示および拒絶証書の作成がなされなければならない(手形法4,27条，77条2項，小切手法8条)。
