A crime in which all of the facts constituting the crime occurred outside Japan and outside of Japanese ships and aircraft. It is for domestic crimes. The current Criminal Code adopts the territorial principle, and in principle, only domestic crimes are punished (Article 1). However, as an exception, protectionism (Article 2) and personalism (Article 3) are adopted, so some crimes committed outside Japan are also punished. 犯罪を構成する事実の全部が日本国外の地で,しかも日本国籍の船舶および航空機の外で生じた犯罪。国内犯に対するものである。現行刑法は属地主義を採用しており,原則として国内犯のみを処罰している (1条) 。しかし例外として保護主義 (2条) ,属人主義 (3条) が採用されているため,一部の国外犯も処罰される。たとえば内乱罪,外患罪,各種偽造罪,放火罪,殺人罪,窃盗罪,強盗罪などである。
