A contract between a building owner (client) and a contractor for construction work. Most are contracts for work under the Civil Code (Article 632 et seq.) (→ Contracts), but there is a strong theory that there are special customary contracts, such as public works contracts, that are not essentially contracts. Construction contracts are regulated by the Construction Business Act (Act No. 100 of 1949) (Articles 18 et seq.), and there is a special dispute resolution system (Articles 25 et seq.), and standard terms and conditions established by construction industry associations and terms and conditions designated by lending institutions are often used. 建築工事について建築主 (施主) と施工者の間にかわされる契約。多くは民法上の請負契約 (632条以下) であるが (→請負 ) ,公共工事請負契約などでは実質的には請負と評価しがたい特殊な慣行的契約が存在するとする有力説がある。建築契約は建設業法 (昭和 24年法律 100号) の規制を受け (18条以下) ,特別な紛争処理制度もある (25条以下) ほか,建設業者団体などの定めた標準約款や融資機関の指定する約款などが用いられることも少くない。
