Criminal Procedure Rules

Japanese: 刑事訴訟規則 - けいじそしょうきそく

Supreme Court Rules No. 32 of 1948. As one of the sources of criminal procedure law, this rule was established by the Supreme Court based on the constitutional power to make rules (Article 77). In principle, legal provisions regarding criminal procedure are based on laws enacted by the Diet (Article 41) due to the requirement of legal procedures in the Constitution (Article 31), but technical matters that do not directly affect the rights and obligations of individuals do not necessarily have to be governed by this law, and it can be said that due to their nature, it is preferable for the judicial power to determine them independently (Article 77, paragraph 1). In that sense, this rule was established as a supplement to the Criminal Procedure Code.

昭和 23年最高裁判所規則 32号。刑事訴訟法の法源の一つとして，憲法上の規則制定権 (77条) に基づき，最高裁判所が定めたもの。刑事訴訟に関する法規定は，憲法の法定手続の要請 (31条) から，国会の定めた法律によることを原則とするが (41条) ，個人の権利義務に直接影響を与えない技術的な事柄については必ずしもそれによる必要はないし，その性質上むしろ司法権が独自に定めたほうが望ましいともいえる (77条1項) 。そのような意味から，刑事訴訟法を補うものとして設けられたものが，この規則である。
