A public servant is not temporarily suspended from performing his/her duties while retaining his/her status. Public servants may not be suspended against their will except for reasons specified by law, namely (1) when they require a long period of rest due to mental or physical disability, (2) when they have been indicted for a criminal offense, or (3) for reasons specified by the rules or ordinances of the National Personnel Authority (National Public Servant Law, Articles 75 and 79; Local Public Servant Law, Articles 27 and 28). In principle, those on suspension are not to receive salary during the period of suspension (National Public Servant Law, Article 80; Law Concerning Salaries of Regular Employees, Article 23). Suspension of service ends automatically when the reason for suspension disappears, and the employee returns to work. Many workplaces also have provisions regarding suspension of service in their work rules or labor agreements.

公務員をその身分を保有したまま一時的にその職務に従事させないこと。公務員は法律に定める事由，すなわち (1) 心身の故障のため，長期の休養を要する場合，(2) 刑事事件に関し起訴された場合，または (3) 人事院規則または条例に定める事由による場合でなければ，その意に反して休職されない (国家公務員法 75，79，地方公務員法 27，28) 。休職者は休職中，原則として給与を受けてはならない (国家公務員法 80，一般職の職員の給与に関する法律 23) 。休職は，その事由が消滅したときには当然に終了し，復職する。事業所でも就業規則や労働協約に休職の定めをもつところが多い。
