… The first foundation mortgage systems established in Japan were factory foundation mortgages under the Factory Mortgage Law, mining foundation mortgages under the Mining Mortgage Law, and railway foundation mortgages under the Railway Mortgage Law, all of which were promulgated in 1905. These are said to have been in response to the demand for funds that accompanied the dramatic expansion of business activities after the Russo-Japanese War. Later, the railway foundation mortgage (the Railway Mortgage Law promulgated in 1905), canal foundation mortgage (the Canal Law promulgated in 1913), fishery foundation mortgage (the Fishery Foundation Mortgage Law promulgated in 1925), port transport business foundation mortgage (the Port Transport Business Law promulgated in 1951), road transport business foundation mortgage (the Road Transport Business Mortgage Law promulgated in 1952), and tourist facility foundation mortgage (the Tourist Facility Foundation Mortgage Law promulgated in 1968) were established. All of these systems are effectively used in their respective business fields, but the factory foundation mortgage system (factory mortgage) is the most commonly used. …
