Work Order - Gyomu Meirei

An order or instruction issued by an employer to an employee to carry out work. Such orders are given in various forms according to the specific needs of each individual, such as work, overtime, business trips, and transfers, and are essential for employers to employ a large number of employees and carry out organizational activities. The basis for the binding force of an order is that the employee has agreed to work under the employer's instructions (subordinate labor) through the labor contract. Therefore, if the order is not followed, the employee will be held responsible for breach of contract and failure to fulfill his/her responsibilities, and will be subject to disciplinary action under the work rules. On the other hand, work orders are only valid within the scope of the labor contract, laws and regulations, labor agreements, work rules, and labor-management practices. Therefore, orders that go against these or that interfere with legitimate union activities are invalid, and in principle have no binding force during a dispute.

業務遂行のため、使用者が従業員に対して発する命令または指示のこと。就労、残業、出張、配転など、個々の具体的必要に応じたさまざまな形態で行われるこのような命令は、使用者が多数の従業員を雇用して組織的に活動を展開するうえで必要不可欠である。命令として強制力をもつ根拠は、労働契約によって従業員が使用者の指揮命令に従って働く(従属労働)ことに合意したという点に求められる。したがって、この命令に従わない場合、契約違反、責務不履行の責めを負うことになり、就業規則などによって懲戒処分の対象とされる。その反面、業務命令は、労働契約、法令、労働協約、就業規則、労使慣行の範囲内でのみ有効である。したがって、これらに反する命令、正当な組合活動を妨害する命令は無効であり、また、争議中は原則として拘束力をもたない。
