Inheritance where there are two or more heirs. Before the Civil Code was revised after World War II, the rule was single inheritance (inheritance by one person), which was the family headship, but after the Civil Code was revised with the new Constitution, the rule of legal inheritance was joint inheritance. Inheritance property is inherited by the joint heirs according to their inheritance shares and belongs to them jointly (Civil Code, Article 898). Some interpret this as joint ownership, but case law has consistently interpreted it as joint ownership and has deemed transfer of shares before division valid. Joint heirs may divide the estate at any time, except when prohibited by the deceased's will (Article 907). When an estate is divided, the inheritance property becomes the sole property of each heir. 相続人が2人以上存在する相続。第2次世界大戦後の民法改正前は,単独相続 (1人相続) である家督相続が原則であったが,新憲法に伴う民法改正以後の法定相続は共同相続が原則となった。相続財産は共同相続人の相続分に応じて承継され,その共有に属する (民法 898) 。これを合有と解する見解もあるが,判例は一貫して共有と解し,分割前の持分譲渡を有効としている。共同相続人は被相続人が遺言で禁じた場合を除くほか,いつでも遺産を分割することができる (907条) 。遺産の分割により相続財産は各相続人の単独所有となる。
