A provision of a law that applies regardless of the will of the parties. It is also called a mandatory provision. In contrast to a mandatory provision, a provision that is provided for in a law but does not apply if the parties express an intention to the contrary is called a discretionary provision. Which legal provisions are mandatory can only be determined from the intent of the law, unless it is clearly stated in the article, but provisions that affect the interests of third parties other than the parties, public order, and good morals are generally mandatory provisions, and many provisions in public law, property law, family law, and inheritance law are considered mandatory provisions.

法令の規定のうちで，当事者の意思にかかわりなく適用される規定。強行法規ともいう。強行規定に対し，法令で規定していても当事者がそれに反する意思表示をすれば適用されない規定を任意規定という。法規のうちどれが強行規定かは，条文に明記してある場合を除き，法令の趣旨から判断するほかはないが，当事者以外の第三者の利害関係や公の秩序，善良の風俗にも影響のある規定は一般に強行規定であり，公法や物権法，親族，相続法の規定の多くは強行規定とされる。
