Risk liability - kikensekinin (English spelling) Gefährdungshaftung

Japanese: 危険責任 - きけんせきにん(英語表記)Gefährdungshaftung
Risk liability - kikensekinin (English spelling) Gefährdungshaftung
A principle of tort liability that requires that anyone who creates a danger to society (such as a dangerous facility or a dangerous company) is always liable for any damages caused by it, regardless of whether they are negligent or not (→ corporate liability). It is also called liability for risk. It is considered one of the grounds for strict liability. The Civil Code imposes heavy liability for structures on land (Article 717), but this is generally interpreted as a recognition of risk liability. It should be contrasted with liability for negligence or fault.
