A principle of tort liability that requires that anyone who creates a danger to society (such as a dangerous facility or a dangerous company) is always liable for any damages caused by it, regardless of whether they are negligent or not (→ corporate liability). It is also called liability for risk. It is considered one of the grounds for strict liability. The Civil Code imposes heavy liability for structures on land (Article 717), but this is generally interpreted as a recognition of risk liability. 不法行為責任についての一つの原則であって,社会に対して危険をつくりだしている者 (たとえば危険な施設,危険な企業) は,それによって生じた損害につき,過失の有無を問わず常に責任を負わなければならないとすることをいう (→企業責任 ) 。危殆責任ともいう。無過失責任を認めるための一つの根拠とされる。民法は土地の工作物について重い責任を課しているが (717条) ,一般に,これは危険責任を認めたものと解されている。過失責任または過失と対比すべきである。
