Recommendation - Korea

An act by which an administrative agency tries to realize the intention of the other party with the voluntary cooperation and consent of the other party. It is a non-authoritative administrative action that does not have legal binding power, and is a de facto act that does not have any direct legal effect on the other party. Recommendations, which are a type of administrative guidance, are subject to control under the Administrative Procedure Act. Recommendations are divided into those between administrative agencies and those made by administrative agencies to private individuals (individuals or corporations) based on their relationship with the other party. Some recommendations have a legal basis, such as the recommendation by the Minister of the Environment to change emission standards to prevent air pollution (Article 5 of the Air Pollution Control Act), but many do not have a legal basis and are made within the scope of the administrative agency's jurisdiction. The content of recommendations is diverse, including the prevention of illegal or unfair acts, conflict resolution, interest adjustment, and technical recommendations.

行政機関が、相手方の任意の協力同意を得て、その意思を実現しようとする行為。その性質については、法的拘束力をもたない非権力的行政作用であり、また、相手方に対して直接になんらの法的効果を伴わない事実行為である。行政指導の一種である勧告は、行政手続法による統制の対象である。勧告は、その相手方との関係で、行政機関相互間におけるものと、行政機関が私人（個人・法人）に対して行うものに分けられる。大気汚染防止のための環境大臣による排出基準変更勧告（大気汚染防止法5条）など法令上の根拠をもつものもあるが、法令上の根拠をもたず、行政機関の所掌事務の範囲内で行われるものが多い。勧告の内容は、違法、不当な行為の防止、紛争の解決、利害調整、技術勧告など多様である。
