The Imperial Criminal Code, enacted in 1532 by the Imperial Diet under the reign of Holy Roman Emperor Charles V, is called the Constitutio Carolina criminalis in Latin. It consists of 219 articles. It was heavily influenced by the Bambergische Halsgerichtsordnung (Bamberg Criminal Court Ordinance) and its author, Johann Schwarzenberg (1463-1528). In the late Middle Ages, as the demand for peace grew in each state, and under the influence of the Roman Canon Criminal Code, punishment changed from compensation to actual imprisonment, including the death penalty, and criminal procedure changed from prosecution by the victim to investigation by the authorities, but legal stability was still lacking.

1532年，神聖ローマ皇帝カール5世治下の帝国議会で成立した帝国刑事法典。ラテン語ではConstitutio Carolina criminalis。219条から成る。バンベルク刑事裁判令Bambergische Halsgerichtsordnungとその起草者であるシュワルツェンベルクJohann Schwarzenberg(1463‐1528)の影響が大である。中世後期には，各領邦において平和の要請が高まるとともに，ローマ･カノン刑事法の影響があって，刑罰は賠償金主義から死刑をはじめとする実刑主義へ，刑事訴訟法は被害者による訴追主義から官憲による糺問主義へと転換するが，いまだ法的安定性に欠けていた。
