A judgment that determines the existence or non-existence of a right or legal relationship. It is for a performance judgment or a formative judgment. In principle, a confirmation judgment arises based on a judgment on the merits made in a declaratory judgment, but if the plaintiff's claim is dismissed in a performance or formative lawsuit, a negative confirmation judgment is made that determines the non-existence of the claim. When a confirmation judgment becomes final, the current legal state between the parties is determined by its res judicata effect. Note that a confirmation suit regarding the existence or non-existence of a fact is not permitted, but a confirmation judgment is made exceptionally only in a suit to determine the authenticity of a document evidencing a legal relationship (Civil Procedure Code).

権利または法律関係の存否を確定する判決。給付判決，形成判決に対するもの。確認の訴えに対して行なわれる本案判決に基づいて生じるのが原則であるが，給付の訴え，形成の訴えで原告の請求を棄却する場合には，その請求権の不存在を確定する消極的確認の判決がなされる。確認判決の確定により，その既判力によって当事者間に現在の法律状態が確定する。なお，事実の存否に関する確認の訴えは許されないが，法律関係を証する書面の真否を確定する訴えにかぎり例外的に確認判決がなされる (民事訴訟法) 。
