Appeal for confirmation - Feststellungsklage
A suit under the Civil Procedure Act. Its content is an assertion of the existence or non-existence of a particular right or legal relationship. There are suits for positive confirmation (for example, a suit for confirmation of ownership) and suits for negative confirmation (for example, a suit for confirmation of the non-existence of a parent-child relationship). A suit for confirmation must be made regarding the existence or non-existence of a current right or legal relationship. However, if the determination of the basic past legal relationship that gave rise to the current rights and relationships is appropriate for the fundamental resolution of the current dispute, the benefit of confirmation is also granted for past legal relationships. As an exception, a suit for confirmation of the authenticity of a document (for example, a will or a promissory note) that certifies a legal relationship is permitted.

民事訴訟法上の訴えの一つ。その内容たる請求が特定の権利または法律関係の存在または不存在の主張であるもの。積極的確認の訴え (たとえば所有権確認の訴え) と消極的確認の訴え (たとえば親子関係不存在確認の訴え) に分かれる。確認の訴えの要件としては,確認の対象が現在の権利または法律関係自体の存否であることが必要である。ただし現在の権利関係を生み出した基礎となる過去の基本的な法律関係について,それを確定することが現在の紛争の抜本的処理に適切であれば過去の法律関係でも確認の利益が認められる。また例外的に,法律関係を証する書面 (たとえば遺言,手形) が真正に作成されたものかどうかという証書真否の確認を求める訴えが許される。
