A marriage performed in an embassy in a foreign country in a manner prescribed by the laws of that country. When performed in a consulate, it is called a consular marriage. Some countries recognize diplomatic marriages between their nationals and foreigners, but the Civil Code only prescribes marriages between Japanese nationals. According to legal precedents, the form of a marriage can be valid either under the law of the place where it is performed or under the national law of one of the parties, so if it is a diplomatic marriage as prescribed by the national law of one of the parties, it will be considered valid in terms of form. However, in the case of a marriage in Japan where one party is Japanese, it must be based on Japanese law, which is the law of the place where it is performed, in family registry practice, so a diplomatic marriage as prescribed by the national law of the foreigner in question cannot be performed in Japan.

外国にある大使館において自国の法律の定める方式で婚姻すること。領事館で行う場合は，領事婚という。自国民と外国人との外交婚を認める国もあるが，民法では，日本人間の婚姻についてのみ定めている。法例によれば，婚姻の方式は，挙行地法または当事者一方の本国法のいずれかで有効とされればよいので，当事者のいずれか一方の本国法の定める外交婚であれば，方式については有効とされることになる。ただし，日本における一方当事者を日本人とする婚姻については，戸籍実務上，必ず挙行地法である日本法によらなければならないので，日本で当該外国人の本国法に定める外交婚をすることはできない。
