Cession (English spelling)

A method of acquiring or losing national territory, in which part of one country's territory is transferred to another country by agreement. Cessations can be made to settle a war or based on negotiations in peacetime. In the former case, part of the territory of the defeated country is handed over to the victorious country in a peace treaty. However, in the 1952 (Showa 27) Treaty of Peace with Japan, Japan renounced all of its overseas territories, but it was not specified to which country it renounced them, leaving unclear issues such as the status of the Northern Territories. Cessations made in peacetime are made by gift, exchange, sale, etc., but are not common these days. Famous examples from the past include the exchange of Sakhalin (Karafuto) and the Kuril Islands agreed upon by Japan and Russia in 1875 (Meiji 8) and the Louisiana Purchase by the United States from France in 1803. In addition, the will of the residents of the ceded territory is an issue, and a referendum may be held. As a result of the cession, the residents usually lose the nationality of the transferring country and acquire the nationality of the receiving country, unless otherwise agreed between the parties.

国家領域の得喪(とくそう)の一方式で、ある国の領域の一部が合意によって他の国に移転することをいう。割譲は、戦争を処理するために行われる場合と、平時における交渉に基づいて行われる場合とがある。前者の場合には、講和(平和)条約により、戦敗国の領域の一部が戦勝国に譲り渡される。ただし、1952年(昭和27)の対日平和条約で、日本はすべての海外領土を放棄したが、どの国に対して放棄したかは明記されなかったため、北方領土の地位など不明確な問題をのちに残した。平時になされる割譲は、贈与、交換、売買などによって生じるが、最近ではあまり行われない。かつての例では、1875年(明治8)に日本とロシアが合意した樺太(からふと)・千島の交換や、1803年のアメリカによるフランスからのルイジアナ購入が有名である。また、割譲地住民の意思が問題とされ、住民投票の実施が定められることがある。割譲の結果、住民は譲渡国の国籍を失って、譲受国の国籍を得るのが普通であるが、当事国間に別段の合意があればそれによる。
