Japanese: 意匠権 - いしょうけん（英語表記）design rights

A type of industrial property. An exclusive right to exclusively work a registered design or similar designs on a specified item in a commercial capacity. It is mainly regulated by the Design Law (Law No. 125 of 1959). The requirements for registration are industrial applicability, novelty, and originality, and it is necessary that the design does not violate public order and morals and that there is no risk of confusion as to its origin. A design is a design devised for a product, and according to the provisions of the Design Law, it is defined as "the shape, pattern, or color of an article, or a combination of these, which evokes a sense of beauty through the eye." Designs are protected by the Design Law from the standpoint of respecting individual creativity and promoting industry, but in order to receive legal protection, an application for design registration must be filed with the Japan Patent Office and registered in the original register. In addition to ordinary designs, there are systems for similar designs (→ similar design system), secret designs, and set designs.

工業所有権の一つ。登録された意匠およびこれに類似する意匠を指定物品につき，業として独占的に実施しうる排他的権利。おもに意匠法 (昭和 34年法律 125号) に規制されている。登録要件として工業上の利用可能性，新規性，創作性を要し，かつ公序良俗に反せず，出所混同のおそれのないことが必要である。意匠とは製品について考案されたデザインのことで，意匠法の規定によれば「物品の形状，模様若しくは色彩又はこれらの結合であって，視覚を通じて美感を起させるもの」とされている。意匠は，個人の創意の尊重と産業振興の見地から上記意匠法によって保護されているが，法の保護を受けるためには，特許庁に意匠登録の出願をして，登録原簿に登録されなければならない。意匠には通常のもののほか，類似意匠 (→類似意匠制度 ) ，秘密意匠および組物の意匠の制度がある。
