A patent granted under the European Community's Unified Patent Convention (signed in 1975, also known as the Luxembourg Convention or the Second Convention). It is also called an EU patent. The effect of such a patent extends to the entire Community, and registration, variation, and expiration are permitted only as a unit, and to that extent the entire Community is treated as if it were one country. This treaty was created based on the idea of the free circulation of goods within the Community, but as of 1997 it has not yet come into force. If this treaty comes into force, the Community will be treated as one country as far as the Community patent is concerned, but the legal situation will be complicated because the national patent laws of each Community country will remain in place.

ヨーロッパ共同体の統一特許条約(1975署名。ルクセンブルク条約あるいは第2条約とも呼ばれる)により付与される特許。EU特許ともいう。その特許の効力は共同体全域に及び，一体としてのみ登録，変動，消滅が認められ，その限りにおいては，共同体全域が一ヵ国のように扱われる。この条約は，共同体内の物資の自由流通という理念に従って作成されたものではあるが，1997年現在未発効である。　この条約が発効すれば，共同体特許に関する限り共同体は一国として扱われるが，共同体各国の国内特許法も存置されるため複雑な法状態となる。
