Insurance terms and conditions

Also called insurance clauses. In an insurance contract, the insurer (insurance company) and the policyholder, who are the parties to the contract, stipulate the contents of the insurance contract, and are often written on the back of the insurance policy. The insurance terms and conditions are prepared unilaterally by the insurer or an organization composed of insurers, but since the financial protection provided by insurance is provided in accordance with the provisions of the insurance terms and conditions, the policyholder in particular must fully understand the contents. There are ordinary insurance terms and conditions that stipulate general, standard, and routine provisions that are uniformly applied to each type of insurance contract, and special insurance terms and conditions (special clauses) that apply when the parties specifically agree to change, supplement, or eliminate them.

保険条項ともいう。保険契約においてその当事者である保険者 (保険会社) と保険契約者が保険契約の内容について約定する条項で，保険証券の裏面に記載されていることが多い。保険約款は保険者または保険者で構成する団体が一方的に作成するが，保険による経済的保障はこの保険約款の定めるところに従ってなされるので，特に保険契約者はその内容を十分理解しておく必要がある。この保険約款には各種の保険契約にそれぞれ画一的に適用される一般的，標準的，定型的な条項を定めた普通保険約款と，それを変更，補充，排除して当事者が特に合意をなした場合に適用される特別保険約款 (特約条項) とがある。
