Interpretation of the law

The process of a trial can be broadly divided into the determination of facts and the application of the law, and legal interpretation is the task of clarifying the meaning of legal texts when applying the law. There are very few clear and unambiguous legal texts that do not require interpretation at all, and the law cannot always be perfectly prescribed while responding to changes in social ideas, so legal interpretation is an essential task in applying the law, and various interpretation techniques have been devised since ancient times, of which traditionally they have been divided into literal interpretation and systematic or logical interpretation.

裁判の過程は事実の認定と法の適用に大別されるが，法の解釈は法の適用に際して法文の意味を明晰化する作業である。解釈をまったく必要としない明確で一義的な法文はごくわずかであり，また法が社会観念の変化に対応しつつつねにもれなく規定することはできないから，法の解釈は法の適用に不可欠の作業であり，古くからさまざまな解釈技術が考案されてきており，そのうち伝統的には文理解釈と体系的解釈ないし論理解釈に区分されてきた。
