Lawyer - Houka

Japanese:
Lawyer - Houka

A school of thought from the Warring States period in China. It refers to a group of politicians and thinkers who advocated a law-based government of rewarding and punishing the meritorious, eliminating the traditional rituals that recognized the privileges of the aristocracy, concentrating power in the monarch, and enriching the country and strengthening its military. Based on a view of humanity that says that human nature is to like profit and hate harm, they advocated controlling subjects by applying the law with rewards (profits) and punishments (harm) without considering education. In contrast to the narrow territorial rule of Confucianism through the influence of virtue, rule by uniform application of the law was suitable for governing a wide territory, and matched the trend of unified control of the entire country and centralization of power. The Han dynasty, which followed the Qin dynasty, is said to have been a Confucian state, but in reality it was a Legalist government. Legalists also advocated the superiority of the whole over the individual, the country over the family, and the monarch over the subjects. Famous thinkers include Shang Yang, who inherited the legal thought of Li Si, Shen Buhai, who excelled in the study of art, Shen Dao, who placed importance on momentum, and Han Fei, who synthesized the ideas of the above three. His works that remain include "Shangjunshu" ("Shangzi"), "Shenzi", "Han Feizi", and "Guanzi".
