For example, a credit relationship between multiple parties that aims to provide a performance that cannot be realized in parts, such as a right to demand delivery when several people jointly buy a house or an obligation to deliver when they sell it jointly, is called an indivisible credit relationship. Of these, those with many creditors are called indivisible creditors (in the previous example, a right to demand delivery by several people), and those with many debtors are called indivisible obligations (in the previous example, an obligation to deliver by several people). Indivisible credit relationships arise when a performance is indivisible by nature or when the parties promise to provide an indivisible performance, but there are few practical examples and they do not play a major role. たとえば,数人が1個の家屋を共同で買った場合の引渡請求権や共同で売った場合の引渡債務のように,分割して実現することのできない給付を目的とする多数当事者の債権関係を不可分債権関係といい,そのうち債権者が多数いるものを不可分債権(前例では数人の引渡請求権),債務者が多数いるものを不可分債務(前例では数人の引渡債務)という。 不可分債権は給付が性質上不可分な場合および当事者が不可分を約した場合に生じるが,実際上の例は少なく,大きな機能を果たしてはいない。
