Reflexive interest
Although it is not a legal right, it refers to an interest that is indirectly brought to a private individual by the law protecting the public interest. While a public right is a legal power that can directly claim a certain interest for oneself, in the case of a reflexive interest, the object of the law is the objective welfare of the general public, so an individual does not have a right to sue in court even if that interest is violated. However, in recent years, even if a reflexive interest, that is, a de facto interest, is not a general abstract interest but a concrete personal interest, and if that interest is violated by an illegal disposition, the view that such an interest deserves legal protection (Administrative Case Litigation Act 9) and should be given judicial protection has become prevalent. Therefore, the distinction between reflexive interests and public rights has become relative.

法律上の権利とはいえないが,法律が公益の保護をはかることによって間接的に私人にもたらされる利益をいう。公権は直接自己のために一定の利益を主張しうる法律上の力であるのに対し,反射的利益の場合は,法律の目的とする対象は客観的な一般人の福利であるので,個人は,たとえその利益を侵されたとしても,裁判所に訴える請求権はもたないとされる。ところが,近年たとえ反射的利益すなわち事実上の利益であっても,その利益が一般的抽象的なものではなく,具体的な個人的利益であって,その利益が違法な処分によって侵されたときには,その種の利益を法律上保護に値する利益 (行政事件訴訟法9) と認め,裁判上保護を与えようとする見解が有力になっている。したがって反射的利益と公権との区別は相対的になってきている。
